{"data":{"id":"us-ut/utah-code-76-8-305","jurisdiction":"us-ut","citation":"Utah Code § 76-8-305","heading":"Interference with a peace officer.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.\n(2) An actor commits interference with a peace officer if the actor:\n(a) knows, or by the exercise of reasonable care should have known, that a peace officer is seeking to effect a lawful arrest or detention of the actor or another individual; and\n(b) interferes with the arrest or detention by:\n(i) use of force or a weapon;\n(ii) refusing to perform an act required by lawful order:\n(A) necessary to effect the arrest or detention; and\n(B) made by a peace officer involved in the arrest or detention; or\n(iii) refusing to refrain from performing an act that would impede the arrest or detention.\n(3) A violation of Subsection (2) is a class B misdemeanor.\n(4) Recording the actions of a peace officer with a camera, mobile phone, or other photographic device, while the peace officer is performing official duties in plain view, does not by itself constitute:\n(a) interference with the peace officer;\n(b) willful resistance;\n(c) disorderly conduct; or\n(d) obstruction of justice.","path":["Title 76 Criminal Offenses","Chapter 76-8 Offenses Against the Administration of Government","Part 76-8-3 Obstructing Governmental Operations"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter8/76-8-S305.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"5466e71423bf91148e23d84880f15aabaa39ae8d49c41493e9784241243a2fcc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-8-303","next":"us-ut/utah-code-76-8-305.5"},"notice":"GroundRules: Original legal text.
