{"data":{"id":"us-ut/utah-code-76-8-603","jurisdiction":"us-ut","citation":"Utah Code § 76-8-603","heading":"Wrongfully issued writ of attachment by a justice court judge.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.\n(2) An actor commits wrongfully issued writ of attachment by a justice court judge if the actor:\n(a) is a justice court judge; and\n(b) issues a writ of attachment in an action, suit, or proceeding:\n(i) before the affidavit is filed; or\n(ii) in which the affidavit filed does not conform substantially with the requirements of Rule 64C of the Utah Rules of Civil Procedure.\n(3) A violation of Subsection (2) is a class B misdemeanor.\n(4) In addition to the penalty under Subsection (3), an actor is liable to the person whose property, credits, money, or earnings are attached for:\n(a) double the value of the attached property;\n(b) all costs paid by the person; and\n(c) all damages incurred in the attachment proceedings.","path":["Title 76 Criminal Offenses","Chapter 76-8 Offenses Against the Administration of Government","Part 76-8-6 Abuse of Process"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter8/76-8-S603.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"c421b46602139b80c065be3c43f7eb1e21b63273ffdf09b8c2318fa5f4250641","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-8-602","next":"us-ut/utah-code-76-8-604"},"notice":"GroundRules: Original legal text.
