{"data":{"id":"us-ut/utah-code-76-8-604","jurisdiction":"us-ut","citation":"Utah Code § 76-8-604","heading":"Wrongful inducement to receive writ of attachment.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.\n(2) An actor commits wrongful inducement to receive writ of attachment if the actor:\n(a) is:\n(i) a party to an action, suit, or proceeding;\n(ii) an agent of a party to an action, suit, or proceeding; or\n(iii) an attorney of a party to an action, suit, or proceeding; and\n(b) advises, induces, or procures the issuance of a writ of attachment in the action, suit or proceeding:\n(i) before the affidavit is filed; or\n(ii) in which the affidavit filed does not conform substantially with the requirements of Rule 64C of the Utah Rules of Civil Procedure.\n(3) A violation of Subsection (2) is a class B misdemeanor.\n(4) In addition to the penalty under Subsection (3), an actor is liable to the person whose property, credits, money, or earnings are attached for:\n(a) double the value of the attached property;\n(b) all costs paid by the person; and\n(c) all damages incurred in the attachment proceedings.","path":["Title 76 Criminal Offenses","Chapter 76-8 Offenses Against the Administration of Government","Part 76-8-6 Abuse of Process"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter8/76-8-S604.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"acfdd3e84e49848ffcb191a13eec5b6ba18953ef8e2fdae4440acce7e3fd3311","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-8-603","next":"us-ut/utah-code-76-8-703"},"notice":"GroundRules: Original legal text.
