{"data":{"id":"us-ut/utah-code-76-9-1104","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1104","heading":"Providing a cigar, a cigarette, an electronic cigarette product, a nicotine product, or tobacco to a minor.","body":"(1)\n(a) As used in this section, \"provides\":\n(i) includes selling, giving, furnishing, sending, or causing to be sent; and\n(ii) does not include the acts:\n(A) of the United States Postal Service or other common carrier when engaged in the business of transporting and delivering packages for others; or\n(B) of a person, whether compensated or not, who transports or delivers a package for another person without any reason to know of the package's content.\n(b) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.\n(2) Except as provided in Subsection (4), an actor commits providing a cigar, cigarette, electronic cigarette product, nicotine product, or tobacco to a minor if the actor knowingly, intentionally, recklessly, or with criminal negligence provides a tobacco product, an electronic cigarette product, or a nicotine product to an individual who is under 21 years old.\n(3) A violation of Subsection (2) is:\n(a) a class C misdemeanor on the first offense;\n(b) a class B misdemeanor on the second offense; or\n(c) a class A misdemeanor on the third or subsequent offense.\n(4) This section does not apply to conduct of an employee of a tobacco retailer that is a violation of Section 76-9-1116.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-11 Cigarettes, Tobacco, and Psychotoxic Chemical Solvents"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1104.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"098ea51079cc0205b80fb36de299fa1642a732286fad97211ac4de21df82c3fe","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1103","next":"us-ut/utah-code-76-9-1105"},"notice":"GroundRules: Original legal text.
