{"data":{"id":"us-ut/utah-code-76-9-1106","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1106","heading":"Buying or possessing a tobacco product or an electronic cigarette product by a minor.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.\n(2) An actor commits buying or possessing a tobacco product or an electronic cigarette product by a minor if the actor:\n(a) is younger than 21 years old; and\n(b) buys or attempts to buy, accepts, or has in the actor's possession a tobacco product, an electronic cigarette product, or a nicotine product.\n(3)\n(a) If the actor is 18 years old or older but younger than 21 years old, a violation of Subsection (2) is:\n(i) an infraction; and\n(ii) subject to:\n(A) a minimum fine or penalty of $60; and\n(B) participation in a court-approved tobacco education or cessation program, which may include a participation fee.\n(b) If the actor is under 18 years old, a violation of Subsection (2) is a citation under Section 80-6-302, unless the violation is committed on school property under Section 53G-8-211.\n(c) If a violation under this section is adjudicated under Section 80-6-701, the minor may be subject to the following:\n(i) a fine or penalty, in accordance with Section 80-6-709; and\n(ii) participation in a court-approved tobacco education program, which may include a participation fee.\n(4)\n(a) A compliance officer appointed by a board of education under Section 53G-4-402 may not issue a citation for a violation of this section committed on school property.\n(b) A cited violation committed on school property shall be addressed in accordance with Section 53G-8-211.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-11 Cigarettes, Tobacco, and Psychotoxic Chemical Solvents"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1106.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"4dfd70b3b9aadbe90b84f09933cec8c7e7c9653cd9a944d87264512cef7ab300","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1105","next":"us-ut/utah-code-76-9-1107"},"notice":"GroundRules: Original legal text.
