{"data":{"id":"us-ut/utah-code-76-9-1110","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1110","heading":"Abuse of psychotoxic chemical solvent.","body":"(1)\n(a) As used in this section, \"psychotoxic chemical solvent\" includes any glue, cement, or other substance containing one or more of the following chemical compounds:\n(i) acetone and acetate;\n(ii) amyl nitrite or amyl nitrate or their isomers;\n(iii) benzene, butyl alcohol, butyl nitrite, butyl nitrate, or their isomers;\n(iv) ethyl alcohol, ethyl nitrite, or ethyl nitrate;\n(v) ethylene dichloride;\n(vi) isobutyl alcohol;\n(vii) methyl alcohol;\n(viii) methyl ethyl ketone;\n(ix) n-propyl alcohol;\n(x) pentachlorophenol;\n(xi) petroleum ether;\n(xii) propyl nitrite or propyl nitrate or their isomers;\n(xiii) toluene;\n(xiv) xylene; or\n(xv) another chemical substance capable of causing a condition of intoxication, inebriation, excitement, stupefaction, or the dulling of the brain or nervous system as a result of the inhalation of the fumes or vapors of such chemical substance.\n(b) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.\n(2) Except as provided in Subsection (4), an actor commits abuse of psychotoxic chemical solvent if:\n(a) for the purpose of causing a condition of intoxication, inebriation, excitement, stupefaction, or the dulling of the actor's brain or nervous system, the actor intentionally:\n(i) smells or inhales the fumes of a psychotoxic chemical solvent; or\n(ii) possesses, purchases, or attempts to possess or purchase a psychotoxic chemical solvent; or\n(b) the actor offers, sells, or provides a psychotoxic chemical solvent to another person, knowing that other person or a third party intends to possess or use that psychotoxic chemical solvent in violation of Subsection (2)(a).\n(3) A violation of Subsection (2) is a class B misdemeanor.\n(4) This section does not apply to:\n(a) the prescribed use, distribution, or sale of a psychotoxic chemical solvent for a medical or dental purpose; or\n(b) a controlled substance regulated by the provisions of Chapter 18, Part 2, Offenses Concerning Controlled Substances, or Title 58, Chapter 37, Controlled Substances.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-11 Cigarettes, Tobacco, and Psychotoxic Chemical Solvents"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1110.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"f33a075185361d03407f4107e6b49b9bc98012a9f5f6d43ca663799a19d531e7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1109","next":"us-ut/utah-code-76-9-1111"},"notice":"GroundRules: Original legal text.
