{"data":{"id":"us-ut/utah-code-76-9-1111","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1111","heading":"Abuse of nitrous oxide.","body":"(1)\n(a) As used in this section, \"nitrous oxide\" means:\n(i) N2O, a colorless gas or liquid that is also referred to as dinitrogen monoxide, nitrogen oxide, or laughing gas; or\n(ii) any substance containing nitrous oxide.\n(b) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.\n(2) Except as provided in Subsection (4), an actor commits abuse of nitrous oxide if the actor:\n(a) possesses nitrous oxide with the intent to breathe, inhale, or ingest the nitrous oxide for the purpose of:\n(i) causing a condition of intoxication, elation, euphoria, dizziness, stupefaction, or dulling of the senses; or\n(ii) in any manner changing, distorting, or disturbing the audio, visual, or mental processes;\n(b) knowingly or intentionally is under the influence of nitrous oxide; or\n(c) offers, sells, or provides nitrous oxide to another person, knowing that other person or a third party intends to possess or use the nitrous oxide in violation of Subsection (2)(a) or (b).\n(3) A violation of Subsection (2) is a class A misdemeanor.\n(4)\n(a) Subsection (2)(b) does not apply to any person who is under the influence of nitrous oxide pursuant to an administration for the purpose of medical, surgical, or dental care by a person holding a license under state law that authorizes the administration of nitrous oxide.\n(b) Subsection (2)(c) does not apply to any person who:\n(i) administers nitrous oxide for the purpose of medical, surgical, or dental care; and\n(ii) holds a license under state law that authorizes the administration of nitrous oxide.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-11 Cigarettes, Tobacco, and Psychotoxic Chemical Solvents"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1111.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"f59e01db1273736e00f1ceca4431f548db4aadbf21517ef675f3b2cd2b888545","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1110","next":"us-ut/utah-code-76-9-1112"},"notice":"GroundRules: Original legal text.
