{"data":{"id":"us-ut/utah-code-76-9-1113","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1113","heading":"Illegal distribution of a tobacco product -- Exceptions.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.\n(2) Except as provided in Subsection (4), an actor commits illegal distribution of a tobacco product if the actor:\n(a) is a manufacturer, wholesaler, or retailer; and\n(b) gives or distributes a tobacco product in this state without charge.\n(3) A violation of Subsection (2) is:\n(a) a class C misdemeanor on the first offense; or\n(b) a class B misdemeanor on a subsequent offense.\n(4)\n(a) A tobacco product may be distributed to an adult without charge at a professional convention where the general public is excluded.\n(b) The prohibition described in Subsection (2) does not apply to a tobacco retailer, a manufacturer, or a distributor that gives a tobacco product to an individual who is 21 years old or older upon the individual's purchase of a tobacco product.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-11 Cigarettes, Tobacco, and Psychotoxic Chemical Solvents"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1113.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"36980722f31e93fd3976f75cc1f29465968e95546359d931d43fb46d1ca76f92","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1112","next":"us-ut/utah-code-76-9-1114"},"notice":"GroundRules: Original legal text.
