{"data":{"id":"us-ut/utah-code-76-9-1116","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1116","heading":"Unlawful sale of a tobacco product, electronic cigarette product, or nicotine product.","body":"(1)\n(a) As used in this section:\n(i) \"Compensatory service\" means service or unpaid work performed by an employee, in lieu of the payment of a fine or imprisonment.\n(ii) \"Employee\" means an employee or an owner of a tobacco retailer.\n(b) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.\n(2) An actor commits unlawful sale of a tobacco product, electronic cigarette product, or nicotine product if the actor:\n(a) is an employee; and\n(b) with criminal negligence, sells or gives a tobacco product, an electronic cigarette product, or a nicotine product in the course of business to an individual younger than 21 years old.\n(3) A violation of Subsection (2) is a class A misdemeanor.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-11 Cigarettes, Tobacco, and Psychotoxic Chemical Solvents"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1116.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"acfa7549244688e5522b51aec9965d26acf724cb349f62bcf90073be0fc9ad99","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1115","next":"us-ut/utah-code-76-9-1117"},"notice":"GroundRules: Original legal text.
