{"data":{"id":"us-ut/utah-code-76-9-1120","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1120","heading":"Unlawful sale of a cannabinoid inhalation product or a cannabinoid inhalation substance.","body":"(1) As used in this section:\n(a) \"Cannabinoid inhalation product\" means an electronic cigarette that contains a cannabinoid.\n(b) \"Cannabinoid inhalation substance\" means a substance containing a cannabinoid that is used or intended for use in an electronic cigarette.\n(c) \"Compensatory service\" means service or unpaid work performed by an employee, in lieu of the payment of a fine or imprisonment.\n(d) \"Employee\" means an employee or an owner of a retailer.\n(2) An actor commits unlawful sale of a cannabinoid inhalation product or a cannabinoid inhalation substance if the actor:\n(a) is an employee; and\n(b) intentionally or knowingly sells or gives a cannabinoid inhalation product or a cannabinoid inhalation substance in the course of business to an individual.\n(3) A violation of Subsection (2) is:\n(a) on a first violation:\n(i) a class C misdemeanor; and\n(ii) subject to:\n(A) a fine not exceeding $1,000; or\n(B) compensatory service; or\n(b) on a subsequent violation:\n(i) a class B misdemeanor; and\n(ii) subject to:\n(A) a fine not exceeding $2,000; or\n(B) compensatory service.\n(4) This section does not prohibit or restrict the sale of medical cannabis or a medical cannabis device if done in accordance with Title 26B, Chapter 4, Part 2, Cannabinoid Research and Medical Cannabis, and with Title 4, Chapter 41a, Cannabis Production Establishments and Pharmacies.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-11 Cigarettes, Tobacco, and Psychotoxic Chemical Solvents"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1120.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"293ae852d3b13b76dc731d4f1c128fcf8cd75b44c298270cef7002cc29cde7d8","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1119","next":"us-ut/utah-code-76-9-1201"},"notice":"GroundRules: Original legal text.
