{"data":{"id":"us-ut/utah-code-76-9-1309","jurisdiction":"us-ut","citation":"Utah Code § 76-9-1309","heading":"Maintenance of a drug-involved premises.","body":"(1) Terms defined in Sections 76-1-101.5 and 76-9-1301 apply to this section.\n(2) An actor commits maintenance of a drug-involved premises if the actor knowingly:\n(a) opens, leases, rents, uses, or maintains any facility or premises, whether permanently or temporarily, for the purpose of the unlawful manufacturing, distributing, or using any controlled substance;\n(b)\n(i) manages or controls any facility or premises, whether permanently or temporarily, as an owner, tenant, lessee, agent, employee, occupant, or mortgagee; and\n(ii) intentionally rents, leases, profits from, or makes available for use, with or without compensation, the facility or premises for the purpose of unlawfully manufacturing, storing, distributing, or using a controlled substance;\n(c) operates a supervised drug consumption site; or\n(d) as an owner, tenant, lessee, agent, employee, occupant, or mortgagee, intentionally opens, rents, leases, profits from, maintains, or makes available for use, with or without compensation, any premises for the purpose of operating a supervised drug consumption site.\n(3) A violation of Subsection (2) is a second degree felony.","path":["Title 76 Criminal Offenses","Chapter 76-9 Offenses Against Public Order, Health, and Safety","Part 76-9-13 Criminal Nuisance"],"source_url":"https://le.utah.gov/xcode/Title76/Chapter9/76-9-S1309.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"e3e4828cb9197c9fd982f513984ee9316966efacb59680d2f72cdb2c8c313bc1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-76-9-1308","next":"us-ut/utah-code-76-9-1401"},"notice":"GroundRules: Original legal text.
