{"data":{"id":"us-ut/utah-code-77-10a-10","jurisdiction":"us-ut","citation":"Utah Code § 77-10a-10","heading":"Charge of grand jury -- Rights and duties.","body":"Upon impanelment of each grand jury, the judge managing the grand jury shall charge the grand jury and inform it of:\n(1) its duty to inquire into offenses against the criminal laws alleged to have been committed within the jurisdiction;\n(2) its independent right to call and interrogate witnesses;\n(3) its right to request the production of documents or other evidence, including exculpatory evidence;\n(4) the necessity of finding credible evidence of each material element of any crime charged before returning an indictment;\n(5) the need to be satisfied that clear and convincing evidence exists that tends to show that a crime was committed by the person or persons accused before returning an indictment;\n(6) its right to have the prosecutor present it with draft indictments for less serious charges than those originally requested by the prosecutor;\n(7) the obligation of secrecy; and\n(8) other duties and rights as the court finds advisable.","path":["Title 77 Criminal Procedure","Chapter 77-10a Grand Jury Reform"],"source_url":"https://le.utah.gov/xcode/Title77/Chapter10a/77-10a-S10.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"42901bcf3d4e9af87ea3d4ac4de01ef5e37469ed0055f6c1d3f7abe03dd4d2fc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-77-10a-9","next":"us-ut/utah-code-77-10a-11"},"notice":"GroundRules: Original legal text.
