{"data":{"id":"us-ut/utah-code-77-11b-101","jurisdiction":"us-ut","citation":"Utah Code § 77-11b-101","heading":"Definitions.","body":"As used in this chapter:\n(1)\n(a) \"Acquitted\" means a finding by a jury or a judge at trial that a claimant is not guilty.\n(b) \"Acquitted\" does not include:\n(i) a verdict of guilty on a lesser or reduced charge;\n(ii) a plea of guilty to a lesser or reduced charge; or\n(iii) dismissal of a charge as a result of a negotiated plea agreement.\n(2) \"Agency\" means the same as that term is defined in Section 77-11a-101.\n(3) \"Claimant\" means the same as that term is defined in Section 77-11a-101.\n(4) \"Complaint\" means a civil or criminal complaint seeking the forfeiture of any property under this chapter.\n(5) \"Department\" means the Department of Criminal Justice created in Section 75E-2-102.\n(6) \"Forfeit\" means to divest a claimant of an ownership interest in property seized under Section 77-11a-201.\n(7) \"Innocent owner\" means the same as that term is defined in Section 77-11a-101.\n(8) \"Interest holder\" means the same as that term is defined in Section 77-11a-101.\n(9) \"Known address\" means:\n(a) any address provided by a claimant to the peace officer or agency at the time the property is seized; or\n(b) the claimant's most recent address on record with a governmental entity if no address was provided at the time of the seizure.\n(10) \"Legal costs\" means the costs and expenses incurred by a party in a forfeiture action.\n(11) \"Legislative body\" means the same as that term is defined in Section 77-11a-101.\n(12) \"Peace officer\" means the same as that term is defined in Section 77-11a-101.\n(13) \"Proceeds\" means the same as that term is defined in Section 77-11a-101.\n(14) \"Program\" means the State Asset Forfeiture Grant Program created in Section 77-11b-403.\n(15) \"Property\" means the same as that term is defined in Section 77-11a-101.\n(16) \"Prosecuting attorney\" means the same as that term is defined in Section 77-11a-101.\n(17) \"Seized property\" means the same as that term is defined in Section 77-11a-101.","path":["Title 77 Criminal Procedure","Chapter 77-11b Forfeiture of Seized Property","Part 77-11b-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title77/Chapter11b/77-11b-S101.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"b64a78b03aedfe904ee592a629661de4610caa948771bfbdaae8208f1dedb0ed","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-77-11a-403","next":"us-ut/utah-code-77-11b-102"},"notice":"GroundRules: Original legal text.
