{"data":{"id":"us-ut/utah-code-77-16a-101","jurisdiction":"us-ut","citation":"Utah Code § 77-16a-101","heading":"Definitions.","body":"As used in this chapter:\n(1) \"Board\" means the Board of Pardons and Parole established under Section 77-27-2.\n(2) \"Department\" means the Department of Health and Human Services.\n(3) \"Executive director\" means the executive director of the Department of Health and Human Services.\n(4) \"Forensic evaluator\" means a licensed mental health professional who is:\n(a) not involved in the defendant's treatment; and\n(b) trained and qualified to conduct a guilty with a mental condition evaluation.\n(5) \"Mental condition\" means the same as that term is defined in Section 76-2-305.\n(6) \"Mental disability\" means the same as that term is defined in Section 76-2-305.\n(7) \"Mental health facility\" means the Utah State Hospital or other facility that provides mental health services under contract with the division, a local mental health authority, or organization that contracts with a local mental health authority.\n(8) \"Mental health supervision\" includes regular and periodic activities including:\n(a) the review of a defendant's assessment, diagnostic formulation, individual service plan development, and progress toward completion of care;\n(b) identification of barriers to a defendant's care, assistance in removing barriers to a defendant's care, continuation of services to a defendant, authorization of care for a defendant, and the observation of the delivery of clinical care to a defendant; and\n(c) the provision of an update report to a court as required under Subsection 77-16a-103(5)(g).\n(9) \"Mental illness\" means the same as that term is defined in Section 76-2-305.\n(10) \"Offender with a mental condition\" means an individual who has been adjudicated guilty with a mental condition.\n(11) \"Secure setting\" means a jail, prison, or locked inpatient medical facility approved by the department.\n(12) \"UDC\" means the Department of Corrections.","path":["Title 77 Criminal Procedure","Chapter 77-16a Commitment and Treatment of Individuals with a Mental Condition","Part 77-16a-1 Plea and Verdict of Guilty with a Mental Condition"],"source_url":"https://le.utah.gov/xcode/Title77/Chapter16a/77-16a-S101.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"ce2e611d63b66947fb062e6265cc00c84c35a75ba476fad63dea7eb0423c68df","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-77-15a-106","next":"us-ut/utah-code-77-16a-102"},"notice":"GroundRules: Original legal text.
