{"data":{"id":"us-ut/utah-code-77-16a-205","jurisdiction":"us-ut","citation":"Utah Code § 77-16a-205","heading":"Parole.","body":"(1) When an offender with a mental condition who has been committed to the department becomes eligible to be considered for parole, the board shall request a recommendation from the executive director and from UDC before placing the offender on parole.\n(2) Before setting a parole date, the board shall request that its mental health adviser prepare a report regarding the offender with a mental condition, including:\n(a) all available clinical facts;\n(b) the diagnosis;\n(c) the course of treatment received at the mental health facility;\n(d) the prognosis for remission of symptoms;\n(e) potential for recidivism;\n(f) an estimation of the dangerousness of the offender with a mental condition either to self or others; and\n(g) recommendations for future treatment.\n(3) Based on the report described in Subsection (2), the board may place the offender with a mental condition on parole. The board may require mental health treatment as a condition of parole. If treatment is ordered, failure to continue treatment, except by agreement with the treatment provider, and the board, is a basis for initiation of parole violation hearings by the board.\n(4)\n(a) The Division of Adult Probation and Parole created in Section 64-14-202 shall monitor the status of an offender with a mental condition who has been placed on parole.\n(b) UDC may provide treatment by contracting with the department, a local mental health authority, any other public or private provider, or in-house staff.\n(5) The board may not subsequently reduce the period of parole without considering an updated report on the offender's current mental condition.","path":["Title 77 Criminal Procedure","Chapter 77-16a Commitment and Treatment of Individuals with a Mental Condition","Part 77-16a-2 Disposition of Defendants Found Guilty with a Mental Condition"],"source_url":"https://le.utah.gov/xcode/Title77/Chapter16a/77-16a-S205.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"cf2dea50914a4c94f66483858fd37357608454020722cbaa0870fb9a7975ea63","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-77-16a-204","next":"us-ut/utah-code-77-16a-301"},"notice":"GroundRules: Original legal text.
