{"data":{"id":"us-ut/utah-code-77-2-2","jurisdiction":"us-ut","citation":"Utah Code § 77-2-2","heading":"Definitions.","body":"As used in this chapter:\n(1) \"Commencement of prosecution\" means the filing of an information or an indictment.\n(2) \"Diversion\" means suspending criminal proceedings before conviction on the condition that a defendant agree to:\n(a) participate in a rehabilitation program;\n(b) pay restitution to a victim; or\n(c) fulfill some other condition.\n(3) \"Restitution\" means the same as that term is defined in Section 77-38b-102.\n(4) \"Screening\" means the process used by a prosecuting attorney to:\n(a) terminate an investigative action;\n(b) proceed with prosecution;\n(c) move to dismiss a prosecution that has been commenced; or\n(d) cause a prosecution to be diverted.","path":["Title 77 Criminal Procedure","Chapter 77-2 Prosecution, Screening, and Diversion"],"source_url":"https://le.utah.gov/xcode/Title77/Chapter2/77-2-S2.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"78d2dec023e8eeb7f173217a8e5035e9beb243d9f597539a26ea54607b5b25b8","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-77-1-7","next":"us-ut/utah-code-77-2-2.1"},"notice":"GroundRules: Original legal text.
