{"data":{"id":"us-ut/utah-code-77-23b-2","jurisdiction":"us-ut","citation":"Utah Code § 77-23b-2","heading":"Interference with access to stored communication -- Offenses -- Penalties.","body":"(1) Except under Subsection (3), a person who obtains, alters, or prevents authorized access to a wire or electronic communication while it is in electronic storage in the system shall be punished under Subsection (2) if the person:\n(a) intentionally accesses without authorization a facility through which an electronic communications service is provided; or\n(b) intentionally exceeds an authorization to access that facility.\n(2) A person who commits a violation of Subsection (1) is:\n(a) if the offense is committed for purposes of commercial advantage, malicious destruction, or damage, or private commercial gain, guilty of a:\n(i) third degree felony for the first offense under this subsection; and\n(ii) second degree felony for any subsequent offense; and\n(b) class B misdemeanor in any other case.\n(3) Subsection (1) does not apply to conduct authorized:\n(a) by the person or entity providing a wire or electronic communications service;\n(b) by a user of that service with respect to a communication of or intended for that user; or\n(c) under Sections 77-23a-10, 77-23b-4, and 77-23b-5.","path":["Title 77 Criminal Procedure","Chapter 77-23b Access to Electronic Communications"],"source_url":"https://le.utah.gov/xcode/Title77/Chapter23b/77-23b-S2.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"1b21203ca169832d6e976d4de582526ecd18b5a214bbbdf5d38f9f4184bb0b85","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-77-23b-1","next":"us-ut/utah-code-77-23b-3"},"notice":"GroundRules: Original legal text.
