{"data":{"id":"us-ut/utah-code-77-38b-204","jurisdiction":"us-ut","citation":"Utah Code § 77-38b-204","heading":"Financial declaration by defendant.","body":"(1)\n(a) The Judicial Council shall design and publish a financial declaration form to be completed by a defendant before the sentencing court establishes a payment schedule under Section 77-38b-205.\n(b) The financial declaration form shall:\n(i) require a defendant to disclose all assets, income, and financial liabilities of the defendant, including:\n(A) real property;\n(B) vehicles;\n(C) precious metals or gems;\n(D) jewelry with a value of $1,000 or more;\n(E) other personal property with a value of $1,000 or more;\n(F) the balance of any bank account and the name of the financial institution for the bank account;\n(G) cash;\n(H) salary, wages, commission, tips, and business income, including the name of any employer or entity from which the defendant receives a salary, wage, commission, tip, or business income;\n(I) pensions and annuities;\n(J) intellectual property;\n(K) accounts receivable;\n(L) accounts payable;\n(M) mortgages, loans, and other debts; and\n(N) restitution that has been ordered, and not fully paid, in other cases; and\n(ii) state that a false statement made in the financial declaration form is punishable as a third degree felony under Section 76-8-504.\n(2) After a plea disposition or conviction has been entered but before sentencing, a defendant shall complete the financial declaration form described in Subsection (1).\n(3) When a civil judgment of restitution or a civil accounts receivable is entered for a defendant on the civil judgment docket under Section 77-18-114, the court shall provide the Office of State Debt Collection with the defendant's financial declaration form.","path":["Title 77 Criminal Procedure","Chapter 77-38b Crime Victims Restitution Act","Part 77-38b-2 Determination of Restitution"],"source_url":"https://le.utah.gov/xcode/Title77/Chapter38b/77-38b-S204.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"2e9a469d211c5fb67a001a77968f85a671459f1dcef716b912c529ddcbc56b40","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-77-38b-203","next":"us-ut/utah-code-77-38b-205"},"notice":"GroundRules: Original legal text.
