{"data":{"id":"us-ut/utah-code-78a-2-113","jurisdiction":"us-ut","citation":"Utah Code § 78A-2-113","heading":"Judicial hiring freeze authorized.","body":"(1) As used in this section, \"General Fund budget deficit\" means a situation where General Fund appropriations made by the Legislature for a fiscal year exceed the estimated revenues adopted by the Executive Appropriations Committee of the Legislature for the General Fund in that fiscal year.\n(2) During a General Fund budget deficit, the governor, president of the Senate, speaker of the House of Representatives, and chief justice of the Supreme Court, may, by unanimous vote, implement a judicial hiring freeze for judicial vacancies for:\n(a) a juvenile court district with three or more juvenile court judges;\n(b) a district court district with three or more district court judges;\n(c) all Business and Chancery Court judges;\n(d) all Constitutional Court judges if Chapter 5b, Constitutional Court, takes effect as described in Section 78A-5b-102;\n(e) all appellate court judges; or\n(f) any combination of Subsections (2)(a) through (e).\n(3) In implementing a judicial hiring freeze, the governor, president of the Senate, speaker of the House, and chief justice of the Supreme Court shall:\n(a) establish the length of that hiring freeze; and\n(b) ensure that the hiring freeze lasts at least 90 days, but not longer than the last day of the annual general session of the Legislature.","path":["Title 78A Judiciary and Judicial Administration","Chapter 78A-2 Judicial Administration","Part 78A-2-1 Judicial Administration"],"source_url":"https://le.utah.gov/xcode/Title78A/Chapter2/78A-2-S113.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"a29c2f6a1aa20c8306142de299377592cbd2daeaf4af7072699b0739b8547b86","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78a-2-112","next":"us-ut/utah-code-78a-2-114"},"notice":"GroundRules: Original legal text.
