{"data":{"id":"us-ut/utah-code-78a-2-303","jurisdiction":"us-ut","citation":"Utah Code § 78A-2-303","heading":"False affidavit -- Penalty.","body":"(1) An individual may assert by affidavit that an affidavit of indigency under Section 78A-2-302, action, or appeal is:\n(a) false;\n(b) frivolous or without merit; or\n(c) malicious.\n(2) Upon receipt of an affidavit in accordance with Subsection (1), the court may notify the affiant of the challenge and set a date, not less than five days from receipt of the notice, requiring the affiant to appear and show cause why the affiant should not be required to:\n(a) post a bond for the costs of the action or appeal; or\n(b) pay the legal fees for the action or appeal.\n(3) The court may dismiss the action or appeal if:\n(a) the affiant does not appear;\n(b) the affiant appears and the court determines the affidavit is false, frivolous, without merit, or malicious; or\n(c) the court orders the affiant to post a bond or pay the legal fees and the affiant fails to do so.","path":["Title 78A Judiciary and Judicial Administration","Chapter 78A-2 Judicial Administration","Part 78A-2-3 Court Fees and Waivers"],"source_url":"https://le.utah.gov/xcode/Title78A/Chapter2/78A-2-S303.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"5eb3abc62bc1cf17ec1b9fe0d3631606ac80e80874e8c86a6804cf6c5e44ec94","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78a-2-302","next":"us-ut/utah-code-78a-2-304"},"notice":"GroundRules: Original legal text.
