{"data":{"id":"us-ut/utah-code-78b-4-304","jurisdiction":"us-ut","citation":"Utah Code § 78B-4-304","heading":"Pleading requirements.","body":"(1) In any action commenced under the provisions of Subsection 78B-4-303(2), the complaint or petition shall state with particularity the following:\n(a) the statute, rule, regulation, ordinance, or other law that was allegedly violated;\n(b) the facts that are alleged to constitute a material violation of the statute, rule, regulation, ordinance, or other law; and\n(c) the facts alleged to demonstrate that the violation proximately caused actual injury to the plaintiff.\n(2) The complaint or petition shall also state with particularity facts sufficient to support a reasonable inference that the violation was with intent to deceive or injure consumers or with the actual knowledge that the violation was injurious to consumers.","path":["Title 78B Judicial Code","Chapter 78B-4 Limitations on Liability","Part 78B-4-3 Commonsense Consumption Act"],"source_url":"https://le.utah.gov/xcode/Title78B/Chapter4/78B-4-S304.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"f863f6b9f96e8f9548b8e92cc704f11afebfc6e6925908aaeb9790cc76318e32","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78b-4-303","next":"us-ut/utah-code-78b-4-305"},"notice":"GroundRules: Original legal text.
