{"data":{"id":"us-ut/utah-code-78b-6-1701","jurisdiction":"us-ut","citation":"Utah Code § 78B-6-1701","heading":"Cause of action for identity theft.","body":"(1) A petitioner who has been injured by a violation of Section 76-6-1102, Identity Fraud, or Section 76-6-525, Communications Fraud, may recover from the perpetrator:\n(a) compensatory damages in the amount of $1,000 or up to three times the amount of actual damages, whichever is greater;\n(b) attorney fees; and\n(c) court costs.\n(2) Actual damages may include:\n(a) replacement or reissuance costs for checks and any personal identification documents;\n(b) the value of the petitioner's time spent:\n(i) repairing their credit history or rating; and\n(ii) attending civil or administrative hearings necessary to resolve any debt, lien, or other obligation arising from the offense;\n(c) lost wages; and\n(d) any other verifiable costs the court may choose to include.\n(3) The court may award punitive damages in addition to compensatory damages.\n(4) A perpetrator who is not tried or found not guilty of a violation of Section 76-6-1102, Identity Fraud, or Section 76-6-525, Communications Fraud, may be found liable under this section if the court finds by a preponderance of the evidence that the perpetrator participated in a violation and the petitioner was injured as a result.\n(5)\n(a) A perpetrator who is found guilty of a violation of Section 76-6-1102, Identity Fraud, or Section 76-6-525, Communications Fraud, shall be found liable under this section.\n(b) If restitution was ordered in the criminal action, the amount ordered shall be deducted from any damages awarded under this section.","path":["Title 78B Judicial Code","Chapter 78B-6 Particular Proceedings","Part 78B-6-17 Civil Action for Identity Theft"],"source_url":"https://le.utah.gov/xcode/Title78B/Chapter6/78B-6-S1701.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"2df59ee33deb161f828b58ce1a89e28f4e8a9e6e52d5d0ee806287064fb05613","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78b-6-1606","next":"us-ut/utah-code-78b-6-1801"},"notice":"GroundRules: Original legal text.
