{"data":{"id":"us-ut/utah-code-78b-6-2404","jurisdiction":"us-ut","citation":"Utah Code § 78B-6-2404","heading":"Accrual of action alleging nonmalignant condition.","body":"Notwithstanding the requirements of Section 78B-2-117, the statute of limitations for an asbestos action alleging a nonmalignant condition that is not time barred on or before May 3, 2023, may not begin to run until the earlier of the day on which:\n(1) the exposed individual is diagnosed with a physical impairment that meets the prima facie evidence requirements of Section 78B-6-2403;\n(2) the exposed individual discovered facts that would have led a reasonable individual to obtain a diagnosis with respect to the existence of a physical impairment from exposure to asbestos that would have met the prima facie evidence requirements of Section 78B-6-2403; or\n(3) the exposed individual dies.","path":["Title 78B Judicial Code","Chapter 78B-6 Particular Proceedings","Part 78B-6-24 Asbestos Litigation Requirements"],"source_url":"https://le.utah.gov/xcode/Title78B/Chapter6/78B-6-S2404.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"43c99fbbdc96fc8a4954e250850ee16fa8c7b01e2d98d32b63b96423eee70bb1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78b-6-2403","next":"us-ut/utah-code-78b-6-2405"},"notice":"GroundRules: Original legal text.
