{"data":{"id":"us-ut/utah-code-78b-6-2603","jurisdiction":"us-ut","citation":"Utah Code § 78B-6-2603","heading":"Manufacturer liability.","body":"(1) A manufacturer of a device is subject to civil liability if:\n(a) a device is activated in the state;\n(b) the device does not, upon activation in the state, enable a filter that complies with the requirements described in Section 78B-6-2602; and\n(c) the minor accesses material that is obscene on the device.\n(2) Notwithstanding Subsection (1), this section does not apply to a manufacturer that makes a good faith effort to provide a device that, upon activation of the device in the state, automatically enables a filter in accordance with Section 78B-6-2602.\n(3) Nothing in this part:\n(a) applies to a device manufactured before January 1, 2025;\n(b) applies to a video game console; or\n(c) creates a cause of action against a retailer of a device.","path":["Title 78B Judicial Code","Chapter 78B-6 Particular Proceedings","Part 78B-6-26 Children's Device Protection Act"],"source_url":"https://le.utah.gov/xcode/Title78B/Chapter6/78B-6-S2603.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"98da09b3047d88f999577dd4bbfe0533a21409886093bf21aa24a2812a7d81bc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78b-6-2602","next":"us-ut/utah-code-78b-6-2604"},"notice":"GroundRules: Original legal text.
