{"data":{"id":"us-ut/utah-code-78b-6-2606","jurisdiction":"us-ut","citation":"Utah Code § 78B-6-2606","heading":"Civil action by parent or legal guardian.","body":"(1) A parent or legal guardian of a minor that accesses obscene content on a device as a result of a manufacturer's failure to comply with of Section 78B-6-2602 may bring a private cause of action in court against the manufacturer.\n(2) A person bringing an action under Subsection (1) may recover:\n(a)\n(i) actual damages; or\n(ii) where actual damages are difficult to ascertain due to the nature of the injury, $50,000 for each violation;\n(b) if a violation is found to be knowing and willful, punitive damages in an amount determined by the court;\n(c) nominal damages;\n(d) attorney fees; and\n(e) such other relief as the court deems appropriate, including court costs and expenses.\n(3) Nothing herein shall preclude the bringing of a class action lawsuit against a manufacturer where the manufacturer's conduct in violation of Section 78B-6-2602 is knowing and willful.\n(4) A parent or legal guardian of a minor may bring an action against any person who is not the parent or legal guardian of the child and who disables the filter from a device in the possession of the child which results in the minor's exposure to obscene content.\n(5) A person bringing an action under Subsection (4) may recover:\n(a)\n(i) actual damages; or\n(ii) where actual damages are difficult to ascertain due to the nature of the injury, $1,000 for each violation; and\n(b) such other relief as the court deems appropriate.","path":["Title 78B Judicial Code","Chapter 78B-6 Particular Proceedings","Part 78B-6-26 Children's Device Protection Act"],"source_url":"https://le.utah.gov/xcode/Title78B/Chapter6/78B-6-S2606.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"ddb8795c4bdfb1e545106afa0d7dbca8031353108cccf6f6985bbeec486167ee","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78b-6-2605","next":"us-ut/utah-code-78b-6-2701"},"notice":"GroundRules: Original legal text.
