{"data":{"id":"us-ut/utah-code-78b-7-1101","jurisdiction":"us-ut","citation":"Utah Code § 78B-7-1101","heading":"Definitions for part.","body":"As used in this part:\n(1) \"Employee\" means:\n(a) an individual who is employed by an employer for compensation; or\n(b) a volunteer.\n(2) \"Employer\" means:\n(a) a person that employs an individual in this state; or\n(b) a nonprofit organization for which volunteers donate services.\n(3) \"Ex parte workplace violence protective order\" means an order issued without notice to the respondent under this part.\n(4) \"Protective order\" means:\n(a) a workplace violence protective order; or\n(b) an ex parte workplace violence protective order.\n(5) \"Workplace violence\" means knowingly causing or threatening to cause bodily injury to, or significant damage to the property of, a person, if:\n(a) the person is:\n(i) an employer;\n(ii) an employee performing the employee's duties as an employee; or\n(iii) an employee who is a volunteer; and\n(b)\n(i) the action would cause a reasonable person to feel terrorized, frightened, intimidated, or harassed; or\n(ii) the threat:\n(A) would cause a reasonable person to fear that the threat will be carried out; and\n(B) if carried out, would cause a reasonable person to feel terrorized, frightened, intimidated, or harassed.\n(6) \"Volunteer\" means an individual who donates services without pay or other compensation to a nonprofit organization except for expenses actually and reasonably incurred by the nonprofit organization.\n(7) \"Workplace violence protective order\" means an order issued under this part after a hearing on the petition, of which the petitioner and respondent have been given notice.","path":["Title 78B Judicial Code","Chapter 78B-7 Protective Orders and Stalking Injunctions","Part 78B-7-11 Workplace Violence Protective Orders"],"source_url":"https://le.utah.gov/xcode/Title78B/Chapter7/78B-7-S1101.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"e083c0e2c749f07b520d2cdc9a28b3d06fc1016cc1e341994016ed3a61d9bd1f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-78b-7-1004","next":"us-ut/utah-code-78b-7-1102"},"notice":"GroundRules: Original legal text.
