{"data":{"id":"us-ut/utah-code-79-2-204","jurisdiction":"us-ut","citation":"Utah Code § 79-2-204","heading":"Division directors -- Appointment -- Removal -- Jurisdiction of executive director.","body":"(1)\n(a) The chief administrative officer of a division within the department is a director appointed by the executive director with the concurrence of the board having policy authority for the division.\n(b) The director of a division may be removed from office by the executive director.\n(c) Notwithstanding the provisions of this section, the appointment and term of office of:\n(i) the state engineer shall be in accordance with Section 73-2-1;\n(ii) the director of the Office of Energy Development shall be in accordance with Subsection 79-6-401(2); and\n(iii) the advisor of the Public Lands Policy Coordinating Office created in Section 63L-11-201 shall be in accordance with Subsection 63L-11-201(2).\n(2)\n(a) The executive director has administrative jurisdiction over a division director for the purpose of implementing department policy as established by the division's board.\n(b) The executive director may:\n(i) consolidate personnel and service functions in the divisions to effectuate efficiency and economy in the operations of the department;\n(ii) establish a departmental services division to perform service functions; and\n(iii) employ law enforcement officers within the department that have all of the powers of a natural resources officer and law enforcement officer, with the exception of the power to serve civil process.","path":["Title 79 Natural Resources","Chapter 79-2 Department of Natural Resources","Part 79-2-2 Department Creation and Administration"],"source_url":"https://le.utah.gov/xcode/Title79/Chapter2/79-2-S204.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"9288eb83979b3befc9c91e650123827d4b84c6a306816f983169066958fcad76","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-79-2-203","next":"us-ut/utah-code-79-2-205"},"notice":"GroundRules: Original legal text.
