{"data":{"id":"us-ut/utah-code-79-6-1107","jurisdiction":"us-ut","citation":"Utah Code § 79-6-1107","heading":"Selection of facility operator.","body":"(1) The council shall initiate the selection of an operator for a decommissioned asset by:\n(a) issuing a request for proposals; and\n(b) publishing the request for proposals on the Utah Public Notice Website created under Section 63A-16-601.\n(2) The request for proposals shall specify that an entity must demonstrate:\n(a) at least 10 years of experience operating coal-fired electrical generation facilities;\n(b) a commitment to maintaining substantial operations within the state;\n(c) financial capability to operate and maintain the facility;\n(d) experience with similar coal types and specifications;\n(e) proven capability to comply with state and federal environmental requirements;\n(f) existing relationships with regional transmission organizations;\n(g) ability to maintain reliable baseload power generation;\n(h) experience with western coal markets and transportation;\n(i) capability to retain the existing skilled workforce; and\n(j) ability to integrate operations with existing transmission infrastructure.\n(3) The council shall:\n(a) allow at least 60 days for the submission of proposals; and\n(b) establish or contract with a technical review committee to evaluate proposals.\n(4) In evaluating proposals, the council shall consider:\n(a) operational efficiency metrics from similar facilities;\n(b) proposed operational cost structure;\n(c) economic considerations;\n(d) reliability and availability guarantees;\n(e) environmental compliance history and plans;\n(f) workplace safety record and plans;\n(g) local economic benefit commitments;\n(h) proposed timeline for assuming operations; and\n(i) the long term power needs of the state and residents of the state.\n(5) Nothing in this section:\n(a) requires the council to select any proposal; or\n(b) prevents the council from:\n(i) rejecting all proposals; or\n(ii) terminating the request for proposals process.","path":["Title 79 Natural Resources","Chapter 79-6 Utah Energy Act","Part 79-6-11 Utah Energy Council"],"source_url":"https://le.utah.gov/xcode/Title79/Chapter6/79-6-S1107.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"d8906b76fee45dd4a0fa9cf1405a710ade50da869bdafae28f44b293a46b022d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-79-6-1106","next":"us-ut/utah-code-79-6-1201"},"notice":"GroundRules: Original legal text.
