{"data":{"id":"us-ut/utah-code-80-2-709","jurisdiction":"us-ut","citation":"Utah Code § 80-2-709","heading":"Division access to criminal background information for background screening and investigation.","body":"(1) The division shall have direct access to criminal background information maintained under Title 53, Chapter 10, Part 2, Bureau of Criminal Identification, for the purpose of:\n(a) background screening under this chapter, Chapter 2a, Removal and Protective Custody of a Child, or Chapter 3, Abuse, Neglect, and Dependency Proceedings, including background screening of an individual who has direct access, as defined in Section 26B-2-101, to a minor:\n(i) who is alleged to be or has been abused, neglected, or dependent; and\n(ii) for whom the division has an open case; or\n(b) investigation of abuse or neglect under this chapter, Chapter 2a, Removal and Protective Custody of a Child, or Chapter 3, Abuse, Neglect, and Dependency Proceedings.\n(2) Except as provided in Section 80-3-305, the division and the Office of Guardian Ad Litem are authorized to request the Department of Public Safety to conduct a complete Federal Bureau of Investigation criminal background check through the national criminal history system (NCIC).","path":["Title 80 Utah Juvenile Code","Chapter 80-2 Child Welfare Services","Part 80-2-7 Child Abuse and Neglect Investigation"],"source_url":"https://le.utah.gov/xcode/Title80/Chapter2/80-2-S709.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"c6d4791154cc5d60c31ba62e4c0712f5df2f4bfc9fcac5b57d710e2a38879ba3","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-80-2-708","next":"us-ut/utah-code-80-2-801"},"notice":"GroundRules: Original legal text.
