{"data":{"id":"us-ut/utah-code-80-3-203","jurisdiction":"us-ut","citation":"Utah Code § 80-3-203","heading":"Expedited hearing for temporary custody.","body":"(1) After an abuse, neglect, or dependency petition is filed, the juvenile court may make an order:\n(a) providing for temporary custody of the child who is the subject of the petition; or\n(b) that the division provide protective services to the child who is the subject of the petition if the juvenile court determines that:\n(i) the child is at risk of being removed from the child's home due to abuse or neglect; and\n(ii) the provision of protective services may make the removal described in Subsection (1)(b)(i) unnecessary.\n(2)\n(a) The juvenile court shall hold an expedited hearing to determine whether a child should be placed in temporary custody if:\n(i) a person files an abuse, neglect, or dependency petition;\n(ii) a party to the proceeding files a motion for expedited placement in temporary custody; and\n(iii) notice of the hearing described in this Subsection (1)(a) is served consistent with the requirements for notice of a shelter hearing under Section 80-3-301.\n(b) The hearing described in Subsection (2)(a):\n(i) shall be held within 72 hours, excluding weekends and holidays, after the time in which the motion described in Subsection (2)(a)(ii) is filed; and\n(ii) shall be considered a shelter hearing under Section 80-3-301 and Utah Rules of Juvenile Procedure, Rule 13.\n(3)\n(a) The hearing and notice described in Subsection (1) are subject to:\n(i) Section 80-3-301;\n(ii) Section 80-3-302; and\n(iii) the Utah Rules of Juvenile Procedure.\n(b) After the hearing described in Subsection (1), the juvenile court may order a child placed in the temporary custody of the division.","path":["Title 80 Utah Juvenile Code","Chapter 80-3 Abuse, Neglect, and Dependency Proceedings","Part 80-3-2 Petition Alleging Abuse, Neglect, or Dependency"],"source_url":"https://le.utah.gov/xcode/Title80/Chapter3/80-3-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"cfb6cc3523f51e8df1d8a0c86efae144fa46ed2bca1bfe8ba18fc8b180fcc456","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-80-3-202","next":"us-ut/utah-code-80-3-204"},"notice":"GroundRules: Original legal text.
