{"data":{"id":"us-ut/utah-code-80-6-802","jurisdiction":"us-ut","citation":"Utah Code § 80-6-802","heading":"Commitment to secure care -- Rights of individuals in secure care.","body":"(1) If a youth offender is ordered to secure care under Section 80-6-705, the youth offender shall remain in secure care until the youth offender is:\n(a) 21 years old;\n(b) paroled; or\n(c) discharged.\n(2) If a serious youth offender is ordered to secure care under Section 80-6-705, the serious youth offender shall remain in secure care until the serious youth offender is:\n(a) 25 years old;\n(b) paroled; or\n(c) discharged.\n(3)\n(a) Subject to Subsection (3)(b), a juvenile offender in secure care, or an individual housed in a secure care facility under Section 80-6-507, has the right to:\n(i) phone the juvenile offender's or individual's parent, guardian, or attorney; and\n(ii) confer in private, at any time, with an attorney, cleric, parent, guardian, or custodian.\n(b) The division may:\n(i) establish a schedule for which a juvenile offender, or an individual housed in a secure care facility under Section 80-6-507, may visit or phone a person described in Subsection (3)(a);\n(ii) allow a juvenile offender, or an individual housed in a secure care facility under Section 80-6-507, to visit or call persons described in Subsection (3)(a) in special circumstances;\n(iii) limit the number and length of calls and visits for a juvenile offender, or an individual housed in a secure care facility under Section 80-6-507, to persons described in Subsection (3)(a) on account of scheduling, facility, or personnel constraints; or\n(iv) limit the juvenile offender's or individual's rights under Subsection (3)(a) if a compelling reason exists to limit the juvenile offender's or individual's rights.\n(c) A juvenile offender in secure care, or an individual housed in a secure care facility under Section 80-6-507, shall be advised of the rights described in Subsection (3)(a).","path":["Title 80 Utah Juvenile Code","Chapter 80-6 Juvenile Justice","Part 80-6-8 Commitment and Parole"],"source_url":"https://le.utah.gov/xcode/Title80/Chapter6/80-6-S802.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"98536703fc5f7a98071f74eb265804269b4ae0b50cec2a15a4c28067f47a018f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-80-6-801","next":"us-ut/utah-code-80-6-803"},"notice":"GroundRules: Original legal text.
