{"data":{"id":"us-ut/utah-code-81-13-405","jurisdiction":"us-ut","citation":"Utah Code § 81-13-405","heading":"Preplacement and postplacement adoptive evaluations -- Review by court.","body":"(1)\n(a) If the person conducting the preplacement adoptive evaluation or postplacement adoptive evaluation disapproves the adoptive placement, the court may dismiss the petition for adoption.\n(b) Upon request by a prospective adoptive parent, the court shall:\n(i) order that an additional preplacement adoptive evaluation or postplacement adoptive evaluation be conducted; and\n(ii) hold a hearing on the suitability of the adoption, including testimony of interested parties.\n(2) Before finalization of a petition for adoption the court shall review and consider the information and recommendations contained in the preplacement adoptive evaluation and postplacement adoptive evaluation described in Sections 81-13-403 and 81-13-404.\n(3) With respect to the home study required as part of the preplacement adoptive evaluation described in Subsection 81-13-403(2)(c), a court may review and consider information other than the information contained in the home study described in Subsection 81-13-403(6)(c).","path":["Title 81 Utah Domestic Relations Code","Chapter 81-13 Adoption","Part 81-13-4 Placement of a Minor Child or Vulnerable Adult for Adoption"],"source_url":"https://le.utah.gov/xcode/Title81/Chapter13/81-13-S405.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"d203f329eef2cdd85a90efde6160e7bd98992b29030b42435513204024ab3d0b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-81-13-404","next":"us-ut/utah-code-81-13-501"},"notice":"GroundRules: Original legal text.
