{"data":{"id":"us-ut/utah-code-81-5-201","jurisdiction":"us-ut","citation":"Utah Code § 81-5-201","heading":"Establishment of parent-child relationship.","body":"(1)\n(a) The mother-child relationship is established between a woman and a child by:\n(i) the woman's having given birth to the child, except as otherwise provided in Part 8, Gestational Agreement;\n(ii) an adjudication of the woman's maternity;\n(iii) adoption of the child by the woman;\n(iv) an adjudication confirming the woman as a parent of a child born to a gestational mother if the agreement was validated under Part 8, Gestational Agreement, or is enforceable under other law; or\n(v) an unrebutted presumption of maternity of the child established in the same manner as under Section 81-5-204.\n(b) In this chapter, the presumption of maternity shall be treated the same as a presumption of paternity as established in Subsection (2)(a).\n(2) The father-child relationship is established between a man and a child by:\n(a) an unrebutted presumption of the man's paternity of the child under Section 81-5-204;\n(b) an effective declaration of paternity by the man under Part 3, Voluntary Declaration of Paternity, unless the declaration has been rescinded or successfully challenged;\n(c) an adjudication of the man's paternity;\n(d) adoption of the child by the man;\n(e) the man having consented to assisted reproduction by a woman under Part 7, Assisted Reproduction, which resulted in the birth of the child; or\n(f) an adjudication confirming the man as a parent of a child born to a gestational mother if the agreement was validated under Part 8, Gestational Agreement, or is enforceable under other law.","path":["Title 81 Utah Domestic Relations Code","Chapter 81-5 Uniform Parentage Act","Part 81-5-2 Parent and Child Relationship"],"source_url":"https://le.utah.gov/xcode/Title81/Chapter5/81-5-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"26b12c2c60f09027f33bd4f82dc7b183b9fafc67a0e3bd1d5527871177743a7a","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-81-5-105","next":"us-ut/utah-code-81-5-202"},"notice":"GroundRules: Original legal text.
