{"data":{"id":"us-ut/utah-code-81-8-704","jurisdiction":"us-ut","citation":"Utah Code § 81-8-704","heading":"Initiation by Department of Health and Human Services of support proceeding under convention.","body":"(1) In a support proceeding under this part, the Utah Department of Health and Human Services shall:\n(a) transmit and receive applications; and\n(b) initiate or facilitate the institution of a proceeding regarding an application in a tribunal of this state.\n(2) The following support proceedings are available to an obligee under the convention:\n(a) recognition or recognition and enforcement of a foreign support order;\n(b) enforcement of a support order issued or recognized in this state;\n(c) establishment of a support order if there is no existing order, including, if necessary, determination of parentage of a child;\n(d) establishment of a support order if recognition of a foreign support order is refused under Subsection 81-8-708(2)(b), (d), or (i);\n(e) modification of a support order of a tribunal of this state; and\n(f) modification of a support order of a tribunal of another state or a foreign country.\n(3) The following support proceedings are available under the convention to an obligor against which there is an existing support order:\n(a) recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this state;\n(b) modification of a support order of a tribunal of this state; and\n(c) modification of a support order of a tribunal of another state or a foreign country.\n(4) A tribunal of this state may not require security, bond, or deposit, however described, to guarantee the payment of costs and expenses in proceedings under the convention.","path":["Title 81 Utah Domestic Relations Code","Chapter 81-8 Uniform Interstate Family Support Act","Part 81-8-7 Support Proceedings Under Convention"],"source_url":"https://le.utah.gov/xcode/Title81/Chapter8/81-8-S704.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:34Z","sha256":"7b574962b817c561ddc90c45fc092552f09007ba453977b65e6991eb79e4ef02","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-81-8-703","next":"us-ut/utah-code-81-8-705"},"notice":"GroundRules: Original legal text.
