{"data":{"id":"us-ut/utah-code-9-6-410","jurisdiction":"us-ut","citation":"Utah Code § 9-6-410","heading":"Public Art Installation Initiative.","body":"(1) As used in this section:\n(a) \"Applicant\" means:\n(i) a county of the first class;\n(ii) a municipality in a county of the first class; or\n(iii) a metro township in a county of the first class.\n(b)\n(i) \"Local funds\" means money in the possession of a county, municipality, or metro township through local revenue generation, private donation, or federal or philanthropic grant.\n(ii) \"Local funds\" does not mean money from a state grant.\n(2) There is created a Public Art Installation Initiative to be administered by the division.\n(3) Within available funds, the division may award an applicant a dollar-for-dollar match on the purchase or commission of a public art installation as described in this section.\n(4) Before the division may offer a dollar-for-dollar match as described in Subsection (3), an applicant shall provide the division with:\n(a) documentation of the local funds dedicated to the proposed public art installation;\n(b) a description or rendering of the proposed public art installation;\n(c) a copy of any contractual agreement the applicant has with the proposed artist, or a template contractual agreement to be offered to an artist; and\n(d) any other information requested by the division.\n(5) The division shall establish by rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act:\n(a) an application process;\n(b) a process to approve or deny an application, in accordance with the purposes described in Section 9-6-402; and\n(c) a process to prioritize applications in the event of limited funding.\n(6) The division:\n(a) may solicit and receive a donation to further the objectives of this section; and\n(b) shall deposit any donation received to further the objectives of this section and reserve the use of that donation for the Public Art Installation Initiative.\n(7) A donation under Subsection (6) may not supplant appropriations for the Public Art Installation Initiative as described in Subsection 9-6-404(2)(b).","path":["Title 9 Cultural and Community Engagement","Chapter 9-6 Arts and Museums Development","Part 9-6-4 Utah Percent-for-Art Act"],"source_url":"https://le.utah.gov/xcode/Title9/Chapter6/9-6-S410.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"a5d9c6e220d47c00d2d2d88ad358ddd9361e4b484608b49cff50636224a0f533","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-9-6-409","next":"us-ut/utah-code-9-6-501"},"notice":"GroundRules: Original legal text.
