{"data":{"id":"us-ut/utah-code-9-9-406","jurisdiction":"us-ut","citation":"Utah Code § 9-9-406","heading":"Savings provision.","body":"Nothing in this part may be construed to:\n(1) limit the authority of a state agency to:\n(a) return or repatriate Native American remains to Indian tribes or individuals; or\n(b) enter into another agreement with the consent of the lineal descendant or culturally affiliated tribe as to the disposition or control over Native American remains;\n(2) delay actions on repatriation requests that are pending on March 17, 1992;\n(3) deny or otherwise affect access to any court, except as provided in Subsection 9-9-403(6);\n(4) limit any procedural or substantive rights that may otherwise be secured to individuals or Indian tribes; or\n(5) limit the application of any state or federal law pertaining to theft or stolen property.","path":["Title 9 Cultural and Community Engagement","Chapter 9-9 Utah Division of Indian Affairs Act","Part 9-9-4 Native American Grave Protection and Repatriation Act"],"source_url":"https://le.utah.gov/xcode/Title9/Chapter9/9-9-S406.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c82ecd993651ae20f110a74aa25e74db935a3a7722fbe5eeeed595dfefdc193b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-9-9-405","next":"us-ut/utah-code-9-9-407"},"notice":"GroundRules: Original legal text.
