A person seeking an exemption from this chapter shall submit a written waiver request in a format specified by the department.\n\nB. A written waiver request shall contain at least the following:\n\n1. The regulation for which the waiver is sought;\n\n2. Detailed facts in support of the waiver request;\n\n3. An explanation of the unique circumstances justifying the request; and\n\n4. Any other information requested by the department.\n\nC. Upon receipt of a waiver request that fails to comply with this section, department staff shall notify the requestor:\n\n1. Of any deficiency in the waiver request; and\n\n2. That the waiver request will not be presented to the board unless the identified deficiency is corrected.\n\nD. Upon receipt of a waiver request that complies with this section, department staff shall present the waiver request to the board as soon as practicable.\n\nE. In evaluating whether to grant a waiver request, the board may consider:\n\n1. The particular facts supporting the waiver request;\n\n2. Whether enforcement of the regulation as to the subject of the waiver request is necessary to protect the public interest or accomplish the policies established by the casino gaming law;\n\n3. Limiting or restricting the relief sought as the board considers necessary in the public interest;\n\n4. Granting the waiver request subject to a condition;\n\n5. Requiring the requestor to submit any additional information; and\n\n6. Any other relevant information.\n\nF. The board shall provide the requestor with written notification of its decision.\n\nG.
