The new resources combined with other resources that the institutionalized spouse intends to retain do not exceed the appropriate medical assistance resource limit for one person, or\n\n2. The institutionalized spouse intends to transfer the new resources to the community spouse during the protected period of eligibility, and the total resources to be transferred do not exceed the community spouse resource allowance.","path":["Title 12.
