The department may enforce the provisions of this chapter and any permits by rule authorized under this chapter in accordance with §§ 10.1-1197.9, 10.1-1197.10, and 10.1-1197.11 of the Code of Virginia. In so doing, the department may:\n\n1. Issue directives in accordance with the law;\n\n2. Issue special orders in accordance with the law;\n\n3. Issue emergency special orders in accordance with the law;\n\n4. Seek injunction, mandamus, or other appropriate remedy as authorized by the law;\n\n5. Seek civil penalties under the law; or\n\n6. Seek remedies under the law, or under other laws including the common law.\n\nB. Pursuant to the Virginia Administrative Process Act (§ 2.2-4000 et seq. of the Code of Virginia), the department may terminate the permit by rule whenever the department finds that the applicant has:\n\n1. Knowingly or willfully misrepresented or failed to disclose a material fact in any report or certification required under this chapter;\n\n2. Failed to comply with the conditions or commitments stated within the permit by rule application; or\n\n3. Violated the project's mitigation plan.","path":["Title 9. Environment","Agency 15.
