VPDES permittees, facilities, and entities subject to this part, with the exception of those covered by waivers under 9VAC25-31-1010, must electronically submit the following VPDES information (reports, notices, waivers, and certifications) after the start dates listed in Table 1 of this subsection. This part is not intended to undo existing requirements for electronic reporting. Prior to this date, and independent of this part, the permittee may be required to report electronically if specified by a particular permit or if required to do so by state law.\n\nTable 1—Start Dates for Electronic Submissions of VPDES Information\n\nVPDES information\n\nStart dates for electronic submissions\n\nGeneral Permit Reports\n\nNotices of Intent to discharge (NOIs) (9VAC25-31-170 B 2 and 9VAC25-875-980)\n\nStart date will be provided in a schedule approved by the department.\n\nNotices of Termination (NOTs) (9VAC25-31-410 and 9VAC25-875-1250)\n\nStart date will be provided in a schedule approved by the department.\n\nNo Exposure Certifications (NOEs) (9VAC25-31-120 E 1 c)\n\nStart date will be provided in a schedule approved by the department.\n\nCertifications in support of waiver for stormwater discharge associated with small construction activity ( 9VAC25-875-20)\n\nStart date will be provided in a schedule approved by the department.\n\nDischarge Monitoring Reports (9VAC25-31-190 L 4 and 9VAC25-875-1000 L 4, as applicable)\n\nIndividual VPDES Permit - Major Facility (9VAC25-31)\n\nJanuary 26, 2018\n\nIndividual VPDES Permit - Minor Facility (9VAC25-31)\n\nJanuary 26, 2018\n\nWatershed General VPDES Permit - Nutrient Discharges (9VAC25-820)\n\nMarch 26, 2018\n\nGeneral VPDES Permit - Industrial Stormwater Discharges (9VAC25-151)\n\nJuly 26, 2018\n\nAll Other General VPDES Permits\n\nStart dates will be provided in a schedule approved by the department.\n\nConcentrated Animal Feeding Operation (CAFO) Annual Program Reports (9VAC25-31-200 E 4)\n\nStart date will be provided in a schedule approved by the department.\n\nMunicipal Separate Storm Sewer System (MS4) Program Reports ( 9VAC25-875-970 D 7 and 9VAC25-875-1010)\n\nStart date will be provided in a schedule approved by the department.\n\nPOTW Pretreatment Program Annual Reports (9VAC25-31-840 I)\n\nStart date will be provided in a schedule approved by the department.\n\nSignificant Industrial User Compliance Reports in Municipalities Without Approved Pretreatment Programs (9VAC25-31-840 E and H)\n\nStart date will be provided in a schedule approved by the department.\n\nSewer Overflow or Bypass Event Reports (9VAC25-31-190 L and M and 9VAC25-875-1000 M and N)\n\nStart date will be provided in a schedule approved by the department.\n\nCWA 316(b) Annual Reports (9VAC25-31-165 B 6 b)\n\nStart date will be provided in a schedule approved by the department.\n\nB. VPDES permittees, facilities, and entities subject to this part shall electronically submit the information listed in Table 1 of this section in compliance with this part and 40 CFR Part 3 (including, in all cases, 40 CFR Part 3 Subpart D), 9VAC25-31-110 or 9VAC25-875-940 as appropriate, and 9VAC25-31-840 L.\n\nC. The department shall be the initial recipient as defined in 40 CFR 127.2(b) and as identified by EPA in 81 FR 62395 (September 9, 2016). VPDES permittees, facilities, and entities subject to this part shall electronically submit the information listed in Table 1 in this section to the department.\n\nD. VPDES permittees, facilities, and entities subject to this part that have received a waiver from electronic reporting shall continue to provide the minimum set of NPDES data (as well as other required information in compliance with statutes, regulations, the VPDES permit, another control mechanism, or an enforcement order) to the department in accordance with 9VAC25-31-1010.","path":["Title 9.
