Except as provided in subsections B and C of this section, this part applies to the appeal of case decisions and other actions or inactions of the department.\n\nB. The provisions of this part do not apply to the appeal of the promulgation of regulations or variances. Appeals of the promulgation of regulations and variances shall be pursued under Article 4 (§ 2.2-4026 et seq.) of the Administrative Process Act.\n\nC. The provisions of this part do not apply to permit actions subject to Part I (9VAC5-80-5 et seq.) of 9VAC5-80 with respect to any party except the named party.","path":["Title 9.
