The provisions of Article 1 (9VAC5-40-60 et seq.) of 9VAC5 Chapter 40 (Emission Standards for Visible Emissions and Fugitive Dust/Emissions, Rule 4-1) apply except that the provisions in subsections B and C of this section apply instead of 9VAC5-40-80.\n\nB. No owner or other person shall cause or permit to be discharged into the atmosphere from any affected facility any gases that exhibit greater than 10% opacity (6-minute average).\n\nC. The owner of an air curtain incinerator with the capacity to combust greater than 250 tons per day of municipal solid waste and that combusts a fuel feed stream composed of 100% yard waste and no other municipal solid waste materials shall at no time cause to be discharged into the atmosphere from that incinerator any gases that exhibit greater than 10% opacity (6-minute average), except that an opacity level of up to 35% (6-minute average) is permitted during startup periods during the first 30 minutes of operation of the unit.","path":["Title 9.
