The following are permit modifications for affected units:\n\n1. Relaxation of an excess emission offset requirement after approval of the offset plan by the administrator.\n\n2. Incorporation of a final nitrogen oxides alternative emission limitation following a demonstration period.\n\n3. Determinations concerning failed repowering projects under 9VAC5-80-460 F 1 and F 3.\n\n4. At the option of the designated representative submitting the permit revision, the permit revisions listed in 9VAC5-80-610 A.\n\nB. An application for a permit modification for an affected unit shall meet the requirements of 9VAC5-80-430 and 9VAC5-80-440 for permit issuance and renewal for the modification proposed.\n\nC. The provisions of 9VAC5-80-690 shall be carried out for permit modifications for affected units in the same manner as they would be for initial permit issuance and renewal.\n\nD. The provisions of 9VAC5-80-670 shall apply to applications made under this section.\n\nE. The department shall take final action on permit modifications for affected units within nine months after receipt of a complete application.\n\nF. The owner shall not make the change applied for under this section until the modification is approved by the department under subsection E of this section.","path":["Title 9. Environment","Agency 5.
