{"data":{"id":"us-vt/11c-v.s.a.-1305","jurisdiction":"us-vt","citation":"11C V.S.A. § 1305","heading":"Proceeds and expenses","body":"(a) Except as otherwise provided in subsection (b) of this section:\n(1) any proceeds or other benefits of a derivative action to enforce a right of a mutual benefit enterprise, whether by judgment, compromise, or settlement, belong to the enterprise and not to the plaintiff; and\n(2) if the plaintiff in the derivative action receives any proceeds, the plaintiff shall immediately remit them to the enterprise.\n(b) If a derivative action to enforce a right of a mutual benefit enterprise is successful in whole or in part, the court may award the plaintiff reasonable expenses, including reasonable attorney’s fees and costs, from the recovery of the enterprise.","path":["Title 11C: Mutual Benefit Enterprises","Chapter 013: Action by Member"],"source_url":"https://legislature.vermont.gov/statutes/section/11C/013/01305","current_through":"2025 session","vintage":"","retrieved_at":"2026-09-05T16:26:57Z","sha256":"f1bc7dea139e8f5903216c4a3e550510a4bb7d53c1621a96285e32b8ccfbbdb5","source_id":"us-vt","stale":false,"prev":"us-vt/11c-v.s.a.-1304","next":"us-vt/11c-v.s.a.-1401"},"notice":"GroundRules: Original legal text.
