{"data":{"id":"us-vt/12-v.s.a.-5716","jurisdiction":"us-vt","citation":"12 V.S.A. § 5716","heading":"Waiver and preclusion of privilege","body":"(a) A privilege under section 5715 of this title may be waived in a record or orally during a proceeding, if it is expressly waived by all parties to the mediation, and:\n(1) in the case of the privilege of a mediator, it is expressly waived by the mediator; and\n(2) in the case of the privilege of a nonparty participant, it is expressly waived by the nonparty participant.\n(b) A person who discloses or makes a representation about a mediation communication which prejudices another person in a proceeding is precluded from asserting a privilege under section 5715 of this title to the extent necessary for the person prejudiced to respond to the representation or disclosure.\n(c) A person who intentionally uses a mediation to plan, attempt to commit, or commit a crime, or conceal an ongoing crime or ongoing criminal activity, may not assert a privilege under section 5715 of this title.","path":["Title 12: Court Procedure","Chapter 194: Uniform Mediation Act"],"source_url":"https://legislature.vermont.gov/statutes/section/12/194/05716","current_through":"2025 session","vintage":"","retrieved_at":"2026-09-05T16:56:27Z","sha256":"b2d8b9fcb23d6527755e84d757db95138f166db0421df2265564846797c0a627","source_id":"us-vt","stale":false,"prev":"us-vt/12-v.s.a.-5715","next":"us-vt/12-v.s.a.-5717"},"notice":"GroundRules: Original legal text.
