{"data":{"id":"us-vt/14a-v.s.a.-1001","jurisdiction":"us-vt","citation":"14A V.S.A. § 1001","heading":"Remedies for breach of trust","body":"(a) A violation by a trustee of a duty the trustee owes to a beneficiary is a breach of trust.\n(b) To remedy a breach of trust that has occurred or may occur, the Probate Division of the Superior Court may:\n(1) compel the trustee to perform the trustee’s duties;\n(2) enjoin the trustee from committing a breach of trust;\n(3) compel the trustee to redress a breach of trust by paying money, restoring property, or other means;\n(4) order a trustee to account;\n(5) appoint a special fiduciary to take possession of the trust property and administer the trust;\n(6) suspend the trustee;\n(7) remove the trustee as provided in section 706 of this title;\n(8) reduce or deny compensation to the trustee;\n(9) subject to section 1012 of this title, void an act of the trustee, impose a lien or a constructive trust on trust property, or trace trust property wrongfully disposed of and recover the property or its proceeds; or\n(10) order any other appropriate relief.","path":["Title 14A: Trusts","Chapter 010: Liability of Trustees and Rights of Persons Dealing with Trustee"],"source_url":"https://legislature.vermont.gov/statutes/section/14A/010/01001","current_through":"2025 session","vintage":"","retrieved_at":"2026-09-05T17:16:59Z","sha256":"5349f000f761f5dbe30bc84e70179ff555585f328e45d325e21c9a649e712dfc","source_id":"us-vt","stale":false,"prev":"us-vt/14a-v.s.a.-908","next":"us-vt/14a-v.s.a.-1002"},"notice":"GroundRules: Original legal text.
