{"data":{"id":"us-vt/18-v.s.a.-4682","jurisdiction":"us-vt","citation":"18 V.S.A. § 4682","heading":"Discrimination against 340B entities prohibited","body":"(a) A manufacturer or its agent shall not deny, restrict, prohibit, or otherwise interfere with, directly or indirectly, the acquisition of a 340B drug by or delivery of a 340B drug to a 340B contract pharmacy on behalf of a 340B covered entity unless receipt by the 340B contract pharmacy is prohibited by the U.S. Department of Health and Human Services.\n(b) A manufacturer or its agent shall not directly or indirectly require a 340B covered entity to submit any claims, utilization, encounter, purchase, or other data as a condition for allowing the acquisition of a 340B drug by or delivery of a 340B drug to a 340B contract pharmacy unless the claims or utilization data sharing is required by the U.S. Department of Health and Human Services.\n(c) A manufacturer or its agent shall not interfere with the ability of a pharmacy contracted with a 340B covered entity to dispense 340B drugs to eligible patients of the 340B covered entity.\n(d) A manufacturer or its agent shall offer or otherwise make available 340B drug pricing to a 340B covered entity or 340B contract pharmacy in the form of a discount at the time of purchase and shall not offer or otherwise make available 340B drug pricing in the form of a rebate.","path":["Title 18: Health","Chapter 091: Prescription Drug Cost Containment","Subchapter 006: 340B DRUG PRICING PROGRAM"],"source_url":"https://legislature.vermont.gov/statutes/section/18/091/04682","current_through":"2025 session","vintage":"","retrieved_at":"2026-09-05T17:17:02Z","sha256":"989b0e655205734d77a95c29219875c6a960c724adbdc0472dc5aebb9554da50","source_id":"us-vt","stale":false,"prev":"us-vt/18-v.s.a.-4681","next":"us-vt/18-v.s.a.-4683"},"notice":"GroundRules: Original legal text.
