{"data":{"id":"us-vt/26-v.s.a.-3271","jurisdiction":"us-vt","citation":"26 V.S.A. § 3271","heading":"Unprofessional conduct","body":"(a) Unprofessional conduct means the following conduct and conduct set forth in 3 V.S.A. § 129a:\n(1) using dishonest or misleading advertising;\n(2) misusing a title in professional activity;\n(3) conduct that evidences unfitness to practice clinical mental health counseling;\n(4) engaging in any sexual conduct with a client, or with the immediate family member of a client, with whom the licensee has had a professional relationship within the previous five years;\n(5) harassing, intimidating, or abusing a client;\n(6) entering into an additional relationship with a client, supervisee, research participant, or student that might impair the licensed clinical mental health counselor’s objectivity or otherwise interfere with the clinical mental health counselor’s professional obligations;\n(7) independently practicing outside or beyond a clinical mental health counselor’s area of training, experience, or competence without appropriate supervision; or\n(8) using conversion therapy as defined in 18 V.S.A. § 8351 on a client younger than 18 years of age.\n(b) After hearing, and upon a finding of unprofessional conduct, the Board may take disciplinary action against a licensed clinical mental health counselor or applicant.","path":["Title 26: Professions and Occupations","Chapter 065: Clinical Mental Health Counselors","Subchapter 001: GENERAL PROVISIONS"],"source_url":"https://legislature.vermont.gov/statutes/section/26/065/03271","current_through":"2025 session","vintage":"","retrieved_at":"2026-09-05T17:17:08Z","sha256":"eac91a5df4d36bfb2aa30e96f70c5e5b68b3eb8deaa6365999b33f25340b16e8","source_id":"us-vt","stale":false,"prev":"us-vt/26-v.s.a.-3270a","next":"us-vt/26-v.s.a.-3272"},"notice":"GroundRules: Original legal text.
