{"data":{"id":"us-wa/rcw-11.68.130","jurisdiction":"us-wa","citation":"RCW 11.68.130","heading":"Power to construe and interpret will.","body":"(1) A personal representative with nonintervention powers has the power to construe and interpret the terms of a probated will, except as the probated will or an order of the court may otherwise direct.\n(2) Unless otherwise provided in the probated will:\n(a) A party, as defined in RCW 11.96A.030, may either petition the court under chapter 11.96A RCW to have an ambiguous provision of a probated will construed by the court or may otherwise address, resolve, and settle the matter under the procedures provided under chapter 11.96A RCW; and\n(b) There is a rebuttable presumption that the construction of an ambiguous provision that is made by a personal representative with nonintervention powers is consistent with the intent of the testator.\n(3) A party, as defined in RCW 11.96A.030, may commence an action to reform the terms of a will as provided in RCW 11.96A.125.","path":["Title 11","Chapter 11.68"],"source_url":"https://app.leg.wa.gov/rcw/default.aspx?cite=11.68.130","current_through":"July 15, 2026","vintage":"","retrieved_at":"2026-09-06T00:58:58Z","sha256":"65ed72bb9e82047a88ba5b6dd4371ef88dc751ca0edded77e8362314d3bfd709","source_id":"us-wa","stale":false,"prev":"us-wa/rcw-11.68.120","next":"us-wa/rcw-11.68.140"},"notice":"GroundRules: Original legal text.
