{"data":{"id":"us-wa/rcw-11.95a.290","jurisdiction":"us-wa","citation":"RCW 11.95A.290","heading":"Disposition of unappointed property—Released or unexercised general power.","body":"To the extent a powerholder releases or fails to exercise a general power of appointment other than a power to withdraw property from, revoke, or amend a trust:\n(1) The gift-in-default clause controls the disposition of the unappointed property; or\n(2) If there is no gift-in-default clause or to the extent the clause is ineffective:\n(a) Except as otherwise provided in (b) of this subsection, the unappointed property passes to:\n(i) The powerholder if the powerholder is a permissible appointee and living; or\n(ii) If the powerholder is an impermissible appointee or deceased, the powerholder's estate if the estate is a permissible appointee; or\n(b) To the extent the powerholder released the power, or if there is no taker under (a) of this subsection, the unappointed property passes under a reversionary interest to the donor or the donor's transferee or successor in interest.","path":["Title 11","Chapter 11.95A"],"source_url":"https://app.leg.wa.gov/rcw/default.aspx?cite=11.95A.290","current_through":"July 15, 2026","vintage":"","retrieved_at":"2026-09-06T00:59:36Z","sha256":"0ffeab87537c3c06f0c18abacc669dca8a335424a8f5e8c9ab0a193b51298208","source_id":"us-wa","stale":false,"prev":"us-wa/rcw-11.95a.280","next":"us-wa/rcw-11.95a.300"},"notice":"GroundRules: Original legal text.
